Waste Collection Earls Court Service Terms and Conditions

These Terms and Conditions set out the basis on which we provide waste collection and related services in Earls Court and surrounding areas. By making a booking, using our services, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any order for waste collection.

1. Definitions

In these Terms and Conditions, the following words have the meanings given:

Customer means the individual, business, landlord, tenant, managing agent, or other organisation requesting or receiving the waste collection service.

We, us, our means the waste collection service provider operating in Earls Court under whose name the booking is made and the invoice is issued.

Services means any waste collection, rubbish removal, recycling, bulky item removal, clearance, or associated services we agree to provide.

Premises means the property, building, or location where the waste is to be collected.

Waste means the materials, items, rubbish, or refuse that the Customer asks us to collect and dispose of, subject to applicable waste regulations.

Contract means the agreement between you and us for the supply of services in accordance with these Terms and Conditions.

2. Scope of Services

We provide scheduled and one-off waste collection services, including domestic and commercial rubbish removal, recycling where available, and the collection of certain bulky items. The precise scope of the services for each booking will be set out and confirmed at the time of booking, including the type and estimated volume or weight of waste, the collection location within Earls Court, and any specific limitations we have advised.

We reserve the right to refuse collection of waste that is hazardous, prohibited, incorrectly described, not safely accessible, or not in line with UK waste regulations. Services do not include cleaning of areas after waste removal unless expressly agreed in writing as an additional service.

3. Booking Process

3.1 You may request a booking for waste collection by phone, email, online form, or any other method made available by us from time to time. You must provide accurate information about the location, type, and approximate quantity of waste, any access restrictions, and any time constraints.

3.2 We will provide an indication of price, availability, and service details based on the information you supply. This will usually be a quotation or an estimate. Your booking is not confirmed until we have accepted it and provided you with a confirmation, verbally or in writing, that specifies the date or time window for collection, the anticipated price structure, and any special conditions.

3.3 By confirming a booking, you warrant that you are the owner of the waste or authorised by the owner to arrange for its collection and disposal, and that you have obtained any necessary consents from property owners, landlords, building managers, or relevant authorities for our operatives to access the premises.

3.4 We may refuse or cancel a booking at our discretion, including where we reasonably believe that the information provided is inaccurate, that the waste described cannot legally be collected or transported, or that access to the premises would pose a safety risk.

4. Access and Customer Obligations

4.1 You must ensure that our operatives have safe and unobstructed access to the premises and to the waste to be collected at the agreed time. This includes arranging any necessary parking, building entry codes, lifts or loading bay access, and ensuring that any pets or occupants do not impede safe working.

4.2 Waste must be presented in a manner suitable for collection. You must comply with our instructions regarding bagging, containment, separation of recyclables, and placement of items. Where large or bulky items are to be removed, you are responsible for disconnecting and uninstalling items such as appliances, fixtures, or equipment before our arrival unless otherwise agreed.

4.3 If our operatives are unable to carry out the service due to lack of access, unsafe conditions, inaccurate information about the nature or quantity of waste, or your failure to comply with these Terms and Conditions, we may charge a call-out fee or a reasonable proportion of the quoted price to cover our costs.

5. Pricing, Estimates, and Quotes

5.1 Prices for waste collection may be based on factors including but not limited to volume, weight, type of waste, labour time, access difficulty, distance to vehicle, permit or parking charges, and disposal or recycling fees. We may provide an estimated price range in advance and confirm the final price on site once we have inspected the waste.

5.2 Any estimate provided prior to inspection is not binding and is subject to change if the actual nature, volume, or weight of the waste differs from that described at the time of booking, or if access is more restricted than anticipated.

5.3 Where we provide a fixed price quotation in writing, it will be valid for the period stated or, if no period is stated, for 30 days from the date of issue, provided that the information you supplied remains accurate and that circumstances at the premises have not materially changed.

5.4 Additional charges may apply for urgent or out-of-hours collections, excessive wait times caused by you or your representatives, missed appointments where our team attends on time, or any services which go beyond the original scope of the booking.

6. Payments and Invoicing

6.1 Unless otherwise agreed in writing, payment is due immediately upon completion of the collection, before our operatives leave the premises. We may accept various payment methods including cash, debit or credit cards, bank transfer, or invoicing for approved commercial customers.

6.2 For business accounts or repeat commercial customers, we may agree to extend credit terms. If so, the payment due date will be specified on the invoice. Time for payment shall be of the essence of the contract.

6.3 If you fail to make payment in full by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate applicable in England and Wales, and to recover any reasonable costs incurred in pursuing late payment, including debt collection and legal fees.

6.4 We may withhold services, refuse further bookings, or suspend any ongoing arrangements if your account is in arrears or if we have reasonable concerns about your ability or willingness to pay.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by contacting us during our normal office hours. We request as much notice as possible so that we can adjust our schedule.

7.2 Where you cancel a booking at least 24 hours before the scheduled collection time, no cancellation fee will typically be charged, unless we have specifically advised of non-refundable charges such as permits or special equipment costs.

7.3 If you cancel less than 24 hours before the scheduled collection time, or if our operatives attend and are unable to complete the service due to your act or omission, we may apply a reasonable cancellation or call-out fee to cover our costs and lost time.

7.4 We may reschedule or cancel a booking due to circumstances beyond our reasonable control, including severe weather, road closures, vehicle breakdown, staff illness, or safety concerns. In such cases we will offer an alternative time for collection as soon as reasonably possible. We will not be liable for any loss arising from such rescheduling or cancellation, save for refunding any pre-paid amounts for services not delivered.

8. Waste Regulations and Prohibited Materials

8.1 We operate in accordance with applicable UK legislation and regulations relating to waste collection, transportation, and disposal. We will only collect and carry waste that we are legally permitted to handle and that has been properly described by you.

8.2 You must not present for collection any waste classified as hazardous, dangerous, or requiring specialist treatment unless we have expressly agreed in advance in writing to handle such materials and are properly licensed and equipped to do so. Examples of materials we may not collect include certain chemicals, asbestos, clinical waste, biological waste, pressurised containers, flammable liquids, and other items restricted by law.

8.3 You are responsible for ensuring that any waste you ask us to collect is lawful for us to carry and that you do not mix prohibited items with general waste. If we discover such items among the waste, we may refuse collection of all or part of the load, or we may isolate and decline the prohibited element. You will remain responsible for any costs or penalties arising from misdescribed or unlawful waste.

8.4 We will dispose of collected waste at authorised facilities in accordance with UK environmental and waste management regulations. Where reasonably practicable, we will seek to reuse or recycle materials rather than send them to landfill, in line with our operating practices and local availability.

9. Customer Representations and Indemnity

9.1 You represent and warrant that:

(a) You have full authority to enter into the contract and to arrange for the collection and disposal of the waste.

(b) All information you provide about the waste, the premises, and access is true, accurate, and complete.

(c) The waste does not include any prohibited or hazardous materials that you have not specifically disclosed and that we have not agreed in writing to collect.

9.2 You agree to indemnify us and hold us harmless from and against any claims, losses, damages, costs, penalties, or expenses arising out of or in connection with:

(a) Your breach of these Terms and Conditions.

(b) Your failure to comply with applicable waste regulations.

(c) Any misdescription of waste or failure to inform us of hazardous or prohibited items.

(d) Any claim brought by a third party relating to ownership of waste or authority to dispose of it.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot be limited or excluded under applicable law.

10.2 Subject to the above, our total liability to you arising out of or in connection with the contract, whether in contract, tort, negligence, breach of statutory duty, or otherwise, shall not exceed the total amount paid or payable by you for the specific service giving rise to the claim.

10.3 We shall not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of anticipated savings, or loss of goodwill arising out of or in connection with the provision of our waste collection services.

10.4 We will exercise reasonable care and skill when carrying out collections, but we shall not be responsible for damage to driveways, paths, access routes, underground services, or surfaces where you have requested that our vehicles or operatives access areas not generally designed for such use, or where the risk of damage was explained or reasonably apparent.

10.5 You are responsible for removing or protecting any items that could be damaged during the handling or removal of waste, and for ensuring that access routes are clear. We will not be liable for minor scuffs, marks, or incidental damage reasonably arising from the normal course of moving waste, provided we have acted with reasonable care.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible, providing your booking details and a clear description of the issue. We will investigate and seek to resolve complaints promptly and fairly.

11.2 Where a dispute arises that cannot be resolved through our internal process, both parties agree to attempt in good faith to resolve the matter through negotiation before commencing formal legal proceedings.

12. Privacy and Data Protection

12.1 We may collect and process personal data relating to you and your representatives for the purposes of managing bookings, delivering services, issuing invoices, and handling enquiries or complaints.

12.2 We will handle any personal information in accordance with applicable UK data protection laws and only retain it for as long as necessary for the purposes for which it was collected or as required by law.

13. Changes to Terms and Conditions

13.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, regulatory requirements, or our business practices. The version in force at the time of your booking will apply to that particular contract.

13.2 Revised terms will be made available upon request. Continuing to place bookings or use our services after changes have been notified will constitute acceptance of the updated Terms and Conditions.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions and any contract for waste collection services are governed by and construed in accordance with the laws of England and Wales.

14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

By placing a booking for waste collection in Earls Court or by allowing our operatives to commence work, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
